Guangdong’s First Local Standard on Data Intellectual Property Officially Implemented

On August 15, 2025, the Guangdong Provincial Local Standard Guidelines for Data Intellectual Property Registration (DB44/T 2664—2025) was officially implemented. This standard, led by the Guangdong Intellectual Property Protection Center, is the first local standard in Guangdong specifically regulating data intellectual property registration, marking a significant breakthrough in the innovation and practical implementation of data intellectual property systems in the province.

• Standardized Registration System: The standard systematically establishes an institutional framework and operational guidelines for data intellectual property registration, filling a regulatory gap.

• Mandatory Pre-registration Deposit Evidence/Notarization: The standard requires that the data collection intended for registration must undergo evidence deposition or notarization before submitting the registration application.

• Refined Categorized Management: The standard classifies data into six source types and requires applicants to submit differentiated, targeted supporting materials based on the source type, ensuring the legality and compliance of data acquisition is thoroughly reviewed.

• Closed-Loop Full-Process Management: The standard not only outlines a clear process for initial registration (real-name registration → evidence deposition/notarization → application → review → publication → certification) but also innovatively systematizes dynamic management mechanisms post-registration.

• Strengthened Security and Compliance Bottom Line: The standard prioritizes compliance, specifying seven scenarios where registration will be denied, including endangering national security, infringing state secrets, harming public interests, illegal sources, unresolved ownership disputes, fraudulent practices, etc., thereby reinforcing security safeguards.

• Transparency and Social Supervision: Registration follows the "principle of openness," requiring the publication of application information and registration results. A public objection procedure is established, allowing any entity or individual to raise objections with real-name authentication and submit evidence. The registration authority will process objections according to procedures, ensuring fairness and credibility.

• Concise and Clear Operational Guidance: The appendix of the standard provides normative application material lists and illustrative flowcharts, making it easier for applicants to understand and operate, thereby enhancing the standardization and convenience of registration services.

The issuance and implementation of the local standard Guidelines for Data Intellectual Property Registration represent a key initiative by Guangdong to implement the national deployment of market-oriented allocation reforms for data elements and to pioneer innovative practices.
